These general terms and conditions of sale (hereinafter referred to as "GTC") apply exclusively between any Customer and RAINETTE, whose registered office is located at 18 passage des sablons 93260 Les Lilas, registered in the Paris Trade and Companies Register under number 833 836 687.

The GTC are applicable without restriction or reservation to all the Articles offered for sale on the Site.
Any Order on the Site is subject to the prior consultation and acceptance by the Customer of these GTC and the applicable rates.
The "click" of the Customer on the "I accept" button, accessible on the page dedicated to the validation of the order, is considered as acceptance.
These GTC take precedence over any other document.
The sale of Articles on the Site is exclusively reserved for retail and private customers.
Under no circumstances may the Site be used by professional selling Customers, alone or in groups, regardless of the marketing method of their products (Internet marketplaces, shopping malls, intermediaries, physical stores in particular). The Customer therefore acknowledges and accepts that the items may only be purchased in quantities corresponding to the average needs of a consumer, both in terms of the number of Articles ordered in a single order, and the number of individual Orders respecting the usual quantity of an average consumer placed for the same product. RAINETTE reserves the right to refuse an order clearly made by a professional selling Customer.
Any Customer declares that he/she is aware of the lack of reliability of the Internet network, especially in terms of relative security in the transmission of data, unsecured continuity not guaranteed in access to the Site, unsecured performance in terms of volume and speed of data transmission and virus propagation.

4. CREATION OF A CUSTOMER ACCOUNT
Anyone can freely and without charge create a customer account via the "Create an account" section.
The creation of a customer account is done by filling in the form that is proposed to the user.
This account is strictly personal and allows them to identify themselves before confirming each Order.
When creating the Customer Account, the customer enters the data that allows him/her to be identified under his/her full responsibility, controls and directions and undertakes to communicate complete, accurate and updated information, and not to impersonate a third party, nor to mask or modify his/her age.
When creating a Customer Account, the customer chooses his username (email) and password.
If the selected ID is already assigned, the system prompts the user to choose another one.
Login and passwords are personal and confidential. If RAINETTE takes all necessary precautions and undertakes to protect its Customers' personal data, the Customer is informed of the need to keep their password secret and not to disclose it to a third party for any reason whatsoever.
In the event of suspicion of third parties being used as identification, the Customer must immediately notify RAINETTE in order to change his password and/or choose to have his customer account closed.
RAINETTE reserves the right to close any customer account and consequently refuse any sale to a Customer in the event of a non-payment of one or more previous Orders.
In this case, RAINETTE sends an email to the Customer concerned at the address provided when creating their customer account, informing them that their username and password have been deactivated and that their account has been closed. The Client is given eight calendar days' notice so that he may make any comments he may have to RAINETTE, without prejudice to the suspension of his Account during the notice period.
In general, the Client is informed that his account may be closed following the Client's first request sent by email to RAINETTE.
5. CHARACTERISTICS OF THE ITEMS
The Items available for sale are those listed on the Site. Offers are valid as long as they are visible on the Site.
They are offered within the limits of availability displayed on the Site.
RAINETTE reserves the right to remove from sale, at any time, any Item on the Site and/or to replace or modify any information associated with the Items on this Site.
In the event of an unavailability of an Item, after placing an Order, the Customer is informed by email, his order being automatically cancelled.
RAINETTE undertakes to refund it as soon as possible and at the latest within 14 days following the cancellation of the order.
The Items for sale on this site, are only available for delivery in the following territories: Metropolitan France, including Corsica and Monaco.
The characteristics of the Items sold on the Site (photographs, graphics and descriptions of the Items, etc...) are given as an indication and may vary over time. Only the visual of the Item displayed at the time of the Order must be taken into account by the Customer. The characteristics and visuals are not contractual.
In the event of errors or omissions in the description of an Item, RAINETTE's liability shall be limited to the reimbursement of the Customer's costs of returning the Item.
6. ORDER OF ITEMS
Any Order implies an obligation to pay.
The Customer declares to be at least 18 years old and to have the legal capacity, or if he is a minor, guarantees to be the holder of a parental authorization to make his Order.
To place an Order, the Customer must follow the online purchase process and click on "Order" to submit the Order.
Payment of the Order constitutes acceptance of these GTC, the price of the items and the content of the Order.
After validation of the payment, RAINETTE sends the Customer an e-mail confirming his Order.
Any Order is subject to RAINETTE's prior acceptance and is definitively confirmed only after the Customer has received an e-mail confirming the dispatch of the Item(s).
Any Order may be refunded if it appears that the conditions under which it was made have breached these GTC.
If the Customer does not receive any email following his Order, it is his responsibility to contact RAINETTE Customer Services in accordance with the procedures described in Article 134 of these GTC.
RAINETTE cannot under any circumstances be held responsible in the event of an input error or transmission of an input error attributable to the customer that does not allow the delivery of the confirmation email and/or the Order.
It is recommended that the Customer prints the email confirming his Order.
For any question relating to the follow-up of an Order, the Customer must consult his customer account on the Site or contact customer services in accordance with the procedures described in Article 14 of these GTC.
7. ITEM PRICES
Prices are indicated on the Site in euros, all taxes included (including VAT), excluding shipping costs.
They take into account VAT and any discounts applicable on the day of the Order.
Any new taxes or contributions, in particular environmental taxes or contributions, are likely to be passed on upwards or downwards in the selling price of the Articles.
The prices of the Products are exclusive of delivery costs (postage, packaging and packing of the package according to the amounts in force).
The amount of shipping costs is specified on the Site before the Order is validated.
RAINETTE reserves the right to modify the prices of the items at any time. But the items being invoiced remain on the basis of the prices in force at the time of the validation of each Order.
The price of the Items invoiced is therefore the one indicated at the time of the Order.
8. PAYMENT OF THE ORDER
Any Order implies an obligation to pay by credit card using a bank account with sufficient funds or by Paypal. The Order is only finalized once the customer has paid the full price and costs associated with the Order.
The price invoiced to the Customer is the price indicated in the Order confirmation sent to the Customer by email.
The Order is payable immediately, by credit card (CB, Visa, MasterCard, American Express) or payment account (Paypal).
The Customer is informed by e-mail, once the Order has been dispatched. His invoice, including delivery charges and VAT applicable on the day of the Order, is accessible online on their customer account.

9. TERMS OF DELIVERY

After validation of the order, it should take between 3 to 5 working days.
- Standard delivery to your home for a shipment of less than 3 cm via lettre verte or lettre recomandée (no tracking possible).
The Customer is informed that it is his responsibility to provide exactly all the details necessary for the proper routing of his Order and perfect delivery (access code, access specification for example).
If the Customer is absent at the time of delivery, a notice will be left informing the Customer of the methods taken to store their package and where the customer can collect it, under the full and exclusive responsibility of the courrier.
The Customer fully and exclusively assumes the risk of loss or damage to the items from the time of delivery.
10. DELIVERY TIME
Items are delivered to the delivery address indicated by the customer at the time of the Order, at the latest by the end of the period indicated at the time of the Order, and this is according to the country of delivery.
RAINETTE makes every effort to ensure that the Order is delivered within 3 to 5 working days from the date of the order’s validation and undertakes that the delivery will be made within a maximum of 30 calendar days from the validation of the Order.
In the event of a delivery delay of more than 7 working days in relation to the above mentioned maximum period, the Customer may contact RAINETTE’s Customer Services department to demand delivery within a reasonable additional time frame. In the event of the non-respect of this new deadline, the customer will be able to ask RAINETTE by e-mail for a refund of their Order.
The contract and therefore the sale will be considered broken upon RAINETTE receiving the email or letter in which the Customer informs them of their decision, unless delivery has occurred between the sending and receipt of the customer’s email or letter.
In the event that the Order is definitively canceled, the Customer will obtain the refund of the price paid for his Order within 14 days following the date of the denunciation by the customer.
Each delivery is deemed complete as soon as the package is made available to the Customer, most often by the courrier, as evidenced by the control system used by the courrier.
If the package is damaged or if the item does not correspond to the order of the Customer, they must engage in the return procedure described in Article 11 below within 30 calendar days after shipment.
11. RIGHT OF WITHDRAWAL AND RETURN PROCEDURES
11.1 Right of withdrawal
Under Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights and Law No 2014-344 of 17 March 2014 as transposed into Articles L. 221-18 et seq. of the Consumer Code, any consumer is entitled to cancel his order at any time within 14 calendar days of the date on which he received the Item(s), without having to justify his reasons or pay penalties.
Under these GTC, RAINETTE wishes to grant the Customer an extended withdrawal period of 30 calendar days. This withdrawal period expires 30 days after the day on which the Customer or a third party other than the carrier and designated by the Customer, physically takes possession of the Order.
To exercise his right of withdrawal, the Customer must notify RAINETTE of their decision to withdraw by means of an unambiguous declaration to the following address:

If the Customer uses this option, RAINETTE will immediately send him/her an acknowledgement of receipt of the withdrawal on a durable medium (e. g. by e-mail).
After having notified RAINETTE of its withdrawal in accordance with these provisions, the Customer must return the Item(s) concerned within a maximum period of 14 days from the date of notification. This deadline is deemed to have been met if the Customer returns the Item(s) concerned before the expiry of the 14-day deadline.
Any withdrawal extended beyond the 30-day period mentioned above will not be accepted.
Only a new, unused and unsoiled item will be refunded. The Article must be returned in its original packaging, or failing that, in packaging guaranteeing equivalent protection, accompanied by the product label.
The return may be made by post in the manner provided below.
11.2 Return procedures
- Returns by post:
Under no circumstances will RAINETTE reimburse the return shipping costs directly paid by the Customer to the Post Office.
To make a return:
1. The Customer must insert in their return box the Item(s) to be returned.
2. The Customer must deposit their package at La Poste.
Once the verification of the returned Item(s) has been carried out, RAINETTE will refund the Customer as soon as possible following notification of the withdrawal request. In the absence of receipt of the item(s) concerned or proof of shipment within this period, RAINETTE reserves the right to postpone the refund until the day of recovery of the item(s) concerned or the provision by the Customer of proof of shipment of the item(s) concerned.
All sums paid under the relevant Item and shipping costs shall be refunded to the Customer (except for additional costs arising from the fact that the Customer has chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by RAINETTE), to the Customer's bank account or payment account used for the payment of the Item(s), under his Order.
The Customer will receive a confirmation email once the refund has been sent. The Customer will be able to consult the return of their package in the "My Orders" section of their Customer area.
In order to track their parcel, the Customer can use the tracking number provided by the Post Office.
12. CUSTOMER SERVICE
For any information or questions, for order tracking, or to activate the warranty, the Customer must contact customer services by email by filling out the contact form located on the contact page of the Site.
The Items are guaranteed against non-conformity and prohibited defects under the conditions provided for in Articles 1641 to 1649 of the Civil Code and L 2171 et seq. of the Consumer Code, from the date of delivery:
The guarantee of hidden defects
Article 1641 of the Civil Code: the seller is bound by the guarantee on account of hidden defects of the item sold which make it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.
Article 1643 of the Civil Code: RAINETTE is bound by this guarantee of hidden defects, even if they didn't know these defects existed, unless, in this case, they have stipulated that they will not be obliged to provide any guarantee.
Article 1644 of the Civil Code: in the case of articles 1641 and 1643, the buyer has the choice of returning the item and getting a full refund, or keeping the item and getting a partial refund of the price.
Article 1646: if the seller was unaware of the defects of the item, they shall only be bound to refund the price and reimburse the buyer for the costs incurred by the sale.
Article 1648 paragraph 1 of the French Civil Code: the action resulting from fundamental defects must be brought to light by the purchaser within two years of the discovery of the defect.
Legal guarantee of conformity
Article L 2171-4 of the Consumer Code: the seller must deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. They shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where the latter has been charged to them by the contract or has been carried out under their responsibility.
Article L 217-5 of the Consumer Code: The good is in conformity with the contract:
1/ If it is specific to the use usually expected of a similar property and, if applicable:
- If it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- If it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling
2/ Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
- Article L. 217-7 paragraph 1 of the Consumer Code: Lack of conformity which appears within 24 months from the delivery of the goods is presumed to exist at the time of delivery, unless proven otherwise.
- Article L. 217-9 of the Consumer Code: In the event of lack of conformity, the buyer chooses between repairing or replacing the goods. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer.
- Article L 217-10 of the Consumer Code: If it is impossible to repair or replace the goods, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded. The same faculty is open to him:
1/ If the solution requested, proposed or agreed pursuant to Article L. 217-9 cannot be implemented within one month of the buyer's complaint;
2/ Or if this solution cannot be done without major inconvenience for the latter, taking into account the nature of the property and the use it seeks.
- However, the sale may not be cancelled if the lack of conformity is minor.
- Article L 217-11 of the Consumer Code: the provisions of articles L. 217-9 and L. 217-10 are applied at no cost to the buyer. These same provisions do not prevent the award of damages.
- Article L 217-12 of the Consumer Code: the action resulting from the lack of conformity is prescribed after two years from the delivery of the goods.
- The Customer may contact RAINETTE via the Site's contact form to collect any information relating to the exercise of these guarantees. In accordance with article 23 of these GTC, the customer shall first contact RAINETTE to seek an amicable solution when they intends to invoke one of the above-mentioned guarantees.
This guarantee allows the Customer to return defective or non-conforming delivered Items for refund under the above-mentioned conditions.
15. EVIDENCE AGREEMENT
The Customer acknowledges and accepts that the Order's recording systems demonstrate all transactions between RAINETTE and the Customer.
The Customer acknowledges that proof of their acceptance of these GTC (and any updates) is indicated by ticking the "I accept" box on the order confirmation page for each order.
The Client acknowledges and accepts that the computerised data stored on RAINETTE's computer servers under reasonable conditions of security and integrity are considered, in an irrefutable manner, as proof of acceptance of the terms of the T&Cs and proof of all transactions between RAINETTE and the Client.
Consequently, unless the Customer proves a manifest error of RAINETTE, the Customer may not contest the admissibility, validity or probative value of the T&Cs and the content of the Order, on the basis of any legal provision which specifies that certain documents must be in writing or signed to constitute proof.
Thus, such evidence constitutes as proof and, if it is produced as evidence by RAINETTE in any contentious or any other proceedings, will be admissible, valid and enforceable in the same manner, under the same conditions and with the same probative force as any document that would be drawn up, received or kept in writing.
At any time, the Customer may print, download and keep a copy of the T&Cs in paper and in electronic form.
RAINETTE reserves the right to modify the information contained in this Site at any time and without notice.
RAINETTE aims to describe with the greatest accuracy the items sold on the Site and to ensure that the information published on the Site is updated as accurately as possible.
However, RAINETTE cannot guarantee the accuracy, precision or exhaustiveness of the information made available to Customers within the Site.
The Customer acknowledges and accepts that the prices of the Items are likely to vary between the Website and the stores, and that under no circumstances may this price difference form the basis for a refund claim, neither in whole nor in part, of the Items purchased either on the Website or in stores outside the exercise of its right of withdrawal under the conditions set out in Article 11 of these GTC.
RAINETTE may not be held liable in the event of failure to fulfil one of its contractual obligations resulting from a fortuitous event or a case of force majeure as defined by the law rendered by the French courts. Force majeure is an external, unpredictable and unavoidable event.
RAINETTE shall not be held liable for any failure or delay in the execution of Orders, caused by events beyond its control ("Force Majeure").
A Force Majeure Event includes any act, event, failure to perform, omission or accident beyond the control of RAINETTE and includes amongst other things (non-exhaustive list):
1. Strikes, closures or other industrial actions.
2. Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or undeclared), or threat or preparation for war.
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters.
4. Impossibility of using transport by rail, ship, aircraft, road or other private or public means of transport.
5. Impossibility of using public and private telecommunications networks.
6. Acts, decrees, legislation, regulations or restrictions of any government.
7. Strikes, malfunctions or accidents in maritime, postal or other transport.
The execution of the T&Cs will be suspended as long as the Force Majeure Event lasts and the execution and delivery times will be extended accordingly. RAINETTE will make every effort to terminate the case of Force Majeure or to find a solution that will enable them to fulfil their contractual obligations despite the case of Force Majeure.
RAINETTE grants the Customer a license limited to personal use of the Site, to the exclusion of any professional or commercial use of the Site.
This Site or any part of this Site may not be reproduced, copied, sold, downloaded, modified or exploited for commercial or professional purposes without RAINETTE's prior written consent.
The customer must not use techniques allowing the copying of a trademark, logo or any other information (in particular images, text, models) owned by RAINETTE without their prior written consent.
RAINETTE authorises the customer, on a non-exclusive and revocable basis, to create a hypertext link to the home page of the Site on condition that this link does not harm RAINETTE's interests.The insertion of a hypertext link that could lead to the belief that the Items are infringing may harm RAINETTE's interests.
Under no circumstances may RAINETTE be held liable for the creation of this hypertext link, for any reason whatsoever.
18. PROTECTION OF PERSONAL DATA
The Client is informed and accepts that their personal data may be collected on the Site used by RAINETTE, which acts as data controller within the terms of Law 78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties as amended on 20 January 2017[and as amended by the General Data Protection Regulation 2016/679 dated 27 April 2016]. RAINETTE undertakes to protect and ensure the security and confidentiality of its Customers' personal data in accordance with the Data Protection Act, in particular, taking all necessary precautions to prevent such data from being distorted, damaged or accessed by unauthorised third parties[In the event of a breach of personal data, RAINETTE shall notify the CNIL of the breach in question as soon as possible. If the violation of personal data is likely to create a high risk for a Client's rights and freedoms, RAINETTE shall inform the data subject as soon as possible of the violation of personal data].
In particular, the personal data of Customers may be transmitted to service providers and contractual partners who, as subcontractors within the terms of the Data Protection Act, are involved and contribute directly to the management of Orders and for whom it is absolutely necessary to access the personal data provided by the Customer when creating and using their Account (identity, postal address, telephone number, e-mail address). Subcontractors may only act on instructions from RAINETTE.
The personal data of Customers is collected for the following purposes:
- the management of Orders and customer relations:
- Customer information relating to offers and commercial information related to the brand;
- the strengthening and improvement of the communication of the Website and the brand by sending newsletters and special offers according to the Customer's preferences noted on the Website;
- the improvement and personalization of the services offered to Customers; and
- compliance with legal and regulatory obligations.
The Client's personal data is kept only for as long as strictly necessary for the purposes previously stated.

The Customer may communicate to RAINETTE specific instructions in which they define the manner in which they intend to exercise, after their death, the « Computer Rights and Freedoms » in accordance with the Data Protection Act.
19. COMMERCIAL OFFERS AND NEWSLETTERS
RAINETTE may send Customers information relating to the Brand Items and commercial offers by post, email, sms, telephone or via all web spaces hosted by RAINETTE on social networks, subject to prior acceptance.
The Customer may at any time object free of charge to these commercial mailings by clicking on the "unsubscribe" link in each email or, by making the request to a shop, via their Internet account, by mail or by replying STOP by SMS.
This "COOKIES" section provides more information on the origin and use of the navigation information processed when visiting our Site and on users' rights.
Thus, when consulting the RAINETTE Site, information relating to navigation may be recorded in "Cookies" files installed on the user's device (computer, tablet, smartphone, etc.).

21. INTELLECTUAL PROPERTY, DOMAIN NAME AND WEBSITE
RAINETTE is the exclusive owner of the intellectual property rights on the following elements, without this list being exhaustive:
• On the Articles offered on the Site, on the brands associated with the Articles;
• On the Site, including its tree, the organization and titling of its headings, the visual and graphic identity, its design, its ergonomics, its features, software, text, animated or still images, sounds, know-how, drawings, graphics and any other element making up the Site;
• On databases, their structure and content, designed and managed by RAINETTE for the purposes of editing the Site;
• On all the elements of conception of the Site that are graphic or technical;
• On names, acronyms, logos, colors, graphics, or other signs that could be used, made or implemented by RAINETTE.
It is therefore forbidden to reproduce in any form whatsoever, directly or indirectly, the elements referred to in this article, as well as to alter the trademarks, patents, names, acronyms, logos, colors, graphics or other signs appearing on the elements made available within the Site, and more generally to use or exploit these elements other than in the context of the execution of these.
As such, the reproduction or use of all or part of these elements is only authorized for personal and private use, any reproduction and any use of copies made for other purposes is expressly prohibited.
22. MODIFICATION OF THE GTCS
Given the possible evolution of the Site and regulations, RAINETTE reserves the right to modify the Terms and Conditions at any time.
Only the GTC in force at the time of the conclusion of the contract will be opposable to the customer.
The new terms and conditions will, if necessary, be brought to the attention of the Customer by modification of the dedicated page of the Site. The Customer will then be asked to expressly consent to the new version of the GTC by "clicking" the "I accept" button for each new order.
The latest version of the GTC can be downloaded on reliable and durable support from the dedicated page of the Site and in the manner indicated in the Preamble.
23. APPLICABLE LAW, MEDIATION, DISPUTES
These Terms are subject to French law.
In case of dispute, the Customer will first contact RAINETTE to find an amicable solution by contacting customer service.
In addition, the European Commission has set up an online dispute resolution platform. The platform is accessible at the following link: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.show&lng=EN
Any dispute will fall under the exclusive jurisdiction of the French courts of the Customer's place of residence, failing an amicable agreement between the Customer and RAINETTE.
